Further to the Interim Management Statement dated 11 November 2009, North Midland Construction PLC confirms that after taking legal advice it has appealed against the recent OFT fine.

North Midland Construction plc notes the announcement from the Office of Fair Trading (OFT) today of its decision to impose fines on 106 companies in the construction sector in England following its investigation into anti-competitive practices. As a result, the OFT is imposing a fine of £1.5m on North Midland Construction plc in relation to two instances in 2001 and 2004. The Company is currently taking legal advice on the findings and on the level of the fines imposed by the OFT, and a further announcement will be made in due course.
